Line 3 2nd Revised FEIS Hearing at the PUC

Minnesota’s Public Utilities Commission held hearings at the MN Senate Building in Downtown St. Paul regarding the 2nd Revised Final Environmental Impact Statement for the Line 3 Replacement Project.

The Commission heard comments directly from the public on Friday, Jan. 31st and statements from the Official Parties involved with the Proceedings on Monday, Feb. 3. As part of the agenda, the PUC had to determine whether the FEIS was now adequate having factored in a potential oil spill in the Lake Superior Watershed and then, based on whether or not the updated spill modeling was “adequate” they had to determine whether to re-issue the Certificate of Need and Route Permit for the project.

Although the Commission ultimately voted three-to-one to approve all three of the agenda items, unlike the 2018 summer decision the outcome was not unanimous. Commissioner Schuerger, who was appointed by Governor Dayton in 2016 to the PUC, dissented against all three items and voted against the motions of the floor.

We documented the hearings and compiled a recap with reactions from several of the environmental groups responding to the decision, including Andy Pearson with MN350, Winona LaDuke with Honor the Earth, Scott Strand representing Friends of the Headwaters, Akilah Sanders-Reed & Brent Murcia with the Youth Climate Intervenors and others involved either with the official proceedings or in supporting groups.

MN PUC Hearing on Adequacy of Line 3 EIS

 

Minnesota’s Public Utilities Commission held a procedural hearing this past Tuesday to determine the course of action which should be taken regarding the June 3rd, 2019 appeals court ruling that the Environmental Impact Statement conducted for Enbridge Energy’s Line 3 Pipeline Replacement Project did not adequately address a potential spill in the Lake Superior Watershed.

Regulatory Capture at MN’s PUC: An Interview with Willis Mattison

 

Minnesota’s Office of the Legislative Auditor has opened an investigation into the Public Utilities Commission Public Engagement Process and held the first public hearing May 31st at 10:00 AM to establish the scope of their investigation.

 

In this video interview outside of the State Office Building, Willis Mattison provides a bit more information about the OLA’s investigation and describes how the PUC is an agency that demonstrated the concept of ‘Regulatory Capture’ in its proceedings on Line 3.

“Expect Resistance” – NVDA during PUC’s Final Day of Deliberation

A direct action kicked off in the early morning of the State of Minnesota’s Public Utilities Commission’s 5th day of deliberation regarding approval of the Enbridge Energy Line 3 Pipeline Replacement Project.

The message, “Expect Resistance”, was displayed loud and clear as news agencies continued to arrive and document over the course of the 3-hour action which shut down 7th. Place East in Downtown St. Paul.

Portage to the PUC

The SEEKJOY Community collaborated on an event to raise awareness about the final four dates of questioning and deliberation by the Public Utilities Commission to determine whether the Line 3 Replacement Pipeline Project should be approved or denied.

The action, “Portage to the PUC” involved participants setting boats in the water at Harriet Island, paddling across the Mississippi River to the concrete landing where Sibley Street meets the river from the downtown side and portaging the canoes with banners & signs to the Metro Square building where the PUC offices are located.

Flying over the Current & Proposed Line 3 Pipeline Route

We had a chance to connect with Bill Paulson, Community Leader at Camp Turtle Island-MikinaakMinis Genawendang Nibi Endazhi-gabeshing outside the White Earth Reservation, as part of a flyover documenting the current and proposed routes for the Line 3 Tar Sands Oil Replacement Project in North/Central Minnesota.

Paulson has been engaged with the resistance effort to oppose the Line 3 Replacement Project for years and is an expert witness with the parties intervening against the proposal. A video of the flyover has been put together and is available below, on the #StopLine3 SCI page as well as via facebook.

 

 

All footage captured during the flyover will be released into the public domain for anybody to use – if you are interested in using the footage stay tuned for the link in a future post.

Final Line 3 Replacement Project PUC Meeting Dates

The Line 3 Replacement Pipeline Project has been undergoing regulatory review in the State of Minnesota for over 3 years and the final verdict will most likely be announced in the final days of June, 2018 after four days of public meetings & deliberation by the PUC.

The meetings will take place in the Large Hearing Room in the Public Utilities Commission building in Downtown St. Paul at 121 7th Place East, Suite 350, St. Paul, MN, 55101.

Meeting Dates:

  • Monday, June 18th, 2018 9:30am
  • Tuesday, June 19th, 2018 9:30am
  • Tuesday, June 26th, 2018 9:30am
  • Wednesday, June 27th, 2018 9:30am

The first two meetings will include final arguments from both sides of the issue and allow for PUC Judges to ask questions. The final two days are scheduled to allow the PUC Judges to deliberate about the decision as they are only (technically) allowed to discuss whether to approve or deny the permits in a public space. All four meetings will be live-streamed via the PUC and we will be working to make sure that feed is accessible via the #StopLine3 SCI Page.

Although all of the “science” has already been submitted to the PUC for review, there is still a massive need to have the public attend these hearings on each day. We will be working to support MN350’s efforts to promote attendance and organizing several ways the public can get involved with raising awareness leading up to, and during, these PUC Meetings.

Block (Line 3) Party @ the PUC Event Recap & Photos

A two-day event called the “Block (Line 3) Party” was organized at 121 7th Place East in front of Minnesota’s Public Utilities Commission by MN350: Building a Climate Movement in Minnesota, Sierra Club Northstar Chapter, Honor the Earth and the Power Shift Network to raise awareness about the upcoming decision by the PUC to either approve or deny the permit for Enbridge Energy’s proposed Line 3 Pipeline Replacement Project in Northern Minnesota.

The Line 3 Replacement Project has been undergoing regulatory approval in the State of Minnesota for over three years. At present, the final decision on whether it can cross the Mississippi Headwaters comes down to whether or not the PUC approves two permits, a “Certificate of Need” and a “Route Permit” for the proposed route south of the existing line and the Leech Lake Reservation.

The Block (Line 3) Party began at 2:30pm on Friday, May 18th, with a march from the State Capital to the PUC building in Downtown St. Paul where a free Wild Rice meal was offered at 4:00pm. A free “Concert to Block Line 3” began at 5:30pm featuring Thomas X, See More Perspective, Jayanthi Kyle & Annie Humphrey.

Midway through the concert a thunderstorm broke out, similar to the storm that seemed to sweep the Oceti Sakowin Camp on February 21st, 2017, the day before the scheduled “Raid”.

Day 2 of the event began with a Water Ceremony on the bank of the Mississippi River at Shepard Road and Sibley Street. A “Pledge of Resistance” gathering began at 10:00am and included a couple words by the organizers of the event and encouraged the public to make a quick statement of why they will stand in resistance against the pipeline and to sign a large banner that will be displayed over the course of the coming weeks leading up to the to PUC Decision.

The event closed with a Direct Action Training from noon to 4pm.

As part of #SYLFFIRE (Support Your Local Fossil Fuel Industry Resistance Effort) SEEKJOY assisted in promoting the event by distributing flyers across the Twin Cities Metro and providing media support during the 2 day event at the PUC.
